Terms of Use

These terms are the ground rules for using fwdnotback.com. In short: watch, read and share links freely, don’t misuse the site or its content, and remember that Forward Not Back is political commentary and conversation, not advice. The numbered sections below are the full terms.

1. Who we are and these terms

Forward Not Back is a nonpartisan political show hosted by Bob Grady. Its website, fwdnotback.com (the “site”), is operated by MK&SJ, LLC (“we,” “us” or “our”).

These Terms of Use (the “terms”) apply whenever you visit or use the site, including its newsletter sign-up forms. By using the site, you agree to these terms. If you don’t agree, please don’t use the site.

Our Privacy Policy explains how we handle personal information.

2. What the site is

The site offers political commentary and conversation: panels, talks, interviews, op-eds and news about the show and its events. It does not take purchases or donations, host comments or accept uploads.

Guests speak for themselves. The views of guests are their own and are not necessarily shared by Bob Grady, Forward Not Back or MK&SJ, LLC.

Commentary, not advice. Nothing on the site is investment, financial, legal or tax advice, and nothing on it is a recommendation to buy, sell or hold any security. Where the site describes Bob Grady’s career, including past investments and board seats, that is biography only. It is not a recommendation, a solicitation or an offer of any security or investment. For decisions about money, law or taxes, talk to a qualified professional.

3. The newsletter

You can join our email newsletter for updates about the show, its events and Bob Grady’s work. Please sign up only with an email address that is yours to use. If you are under 13, or under 16 in the European Economic Area or the United Kingdom, please don’t sign up.

You can unsubscribe at any time using the instructions or link in any of our emails, or by writing to contact@fwdnotback.com. We may change how often we send the newsletter, or stop it, at any time. Our Privacy Policy explains how we handle your address.

4. Using the site

You may view the site, watch its videos, read its articles and share links to its pages for your own personal, non-commercial use. If you’d like to use our content in another way, such as republishing a video or an article, please email us for permission first. Nothing in these terms limits any use the law allows without permission, such as fair use. Search engines and AI services may read the site’s pages to index, cite or summarize them.

When you use the site, you agree not to:

• copy, republish, sell, license or otherwise use the site’s content for commercial purposes without our written permission, except as the law allows;
• edit, alter or present content from the site, including quotes, images and footage, whether by hand or with AI or other tools, in a way that is misleading or suggests that Bob Grady, a guest or Forward Not Back said, did or endorsed something they did not;
• use the Forward Not Back name or logos, or the name or likeness of Bob Grady or any guest, in a way that suggests sponsorship, endorsement or affiliation without permission;
• impersonate Forward Not Back, Bob Grady, a guest or anyone else, or misrepresent your connection with us;
• sign anyone else up for the newsletter without their permission, or submit fake or automated sign-ups;
• use bots, scrapers or other automated tools in a way that overloads the site or gets in the way of other visitors;
• hack, probe or test the security of the site or our service providers, interfere with how the site works, or introduce viruses or other harmful code; or
• use the site in any way that breaks the law or violates anyone else’s rights.

If you break these terms, your permission to use the site ends.

5. Our content

Unless otherwise noted, and apart from the third-party material described in section 6, the site and its content are owned by or licensed to MK&SJ, LLC. That includes the site’s text, design, graphics and logos, the Forward Not Back name, and the original video we produce. This content is protected by copyright, trademark and other laws, and we reserve all rights not expressly granted in these terms.

6. Third-party content, trademarks and links

The site shows and links to material that belongs to others, such as news articles, TV and conference video, and photographs, for biographical, news and commentary purposes. That material, and the names, logos and trademarks that appear in it, belong to their owners. Bob Grady’s op-eds are either linked at the outlet that published them or reproduced from his own copy, and the rights in them remain with their owners.

News outlets, schools, companies and other organizations are named on the site only to identify sources, people and events. Showing or naming them does not mean they sponsor, endorse or are affiliated with Forward Not Back.

Links to other websites and platforms are there for convenience. We don’t control those sites and aren’t responsible for their content, availability or practices, and a link doesn’t mean we endorse everything on them. Their own terms and privacy policies apply when you use them.

7. Illustrative footage

Some background video and imagery on the site is illustrative. It may include stock, archival or computer-generated footage and images, and it is there to set the scene, not to document a particular event. Illustrative footage doesn’t necessarily show the people, places or events being discussed, and the appearance of a person or organization in it doesn’t mean they endorse or are affiliated with Forward Not Back.

8. Copyright complaints

We respect the rights of creators and owners. If you believe material on the site infringes your copyright, email contact@fwdnotback.com with:

• your physical or electronic signature, or that of a person authorized to act for the copyright owner;
• a description of the copyrighted work you believe has been infringed;
• a description of the material you believe is infringing and where it appears on the site, ideally with its web address;
• your name, postal address, phone number and email address;
• a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law; and
• a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner’s behalf.

We will review each notice and remove or disable material where appropriate. Please note that knowingly misrepresenting that material is infringing can make you liable for damages.

If you have another concern about material on the site, such as a photo of you, write to the same address.

9. Disclaimers

The site and everything on it are provided “as is” and “as available,” without warranties of any kind, whether express or implied. To the fullest extent the law allows, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement and accuracy.

We don’t promise that the site will always be available, uninterrupted, secure or free of errors or harmful code, or that its content is accurate, complete or up to date. Polls, forecasts, figures and opinions discussed on the show can be incomplete, outdated or wrong, and elections and events can turn out differently. You use the site, and rely on its content, at your own risk.

10. Limitation of liability

In this section and the next, the “Forward Not Back parties” means MK&SJ, LLC, its members, managers, employees, contractors and agents, and the host and team of Forward Not Back.

To the fullest extent the law allows, the Forward Not Back parties will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to the site or these terms, even if they were told such damages were possible. The total liability of the Forward Not Back parties for all claims arising out of or relating to the site or these terms is limited to one hundred U.S. dollars (US$100).

Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, such as liability for fraud, or for death or personal injury caused by negligence. Some places don’t allow certain warranty disclaimers or limits on liability, so parts of sections 9 and 10 may not apply to you.

11. Indemnity

To the extent the law allows, you agree to defend, indemnify and hold harmless the Forward Not Back parties from any claims, losses, liabilities, damages, costs and expenses, including reasonable attorneys’ fees, arising out of your misuse of the site, your breach of these terms, or your violation of any law or anyone else’s rights.

12. Governing law and where disputes are heard

These terms, and any dispute arising out of or relating to them or the site, are governed by the laws of the state in which MK&SJ, LLC is organized and by applicable U.S. federal law, without regard to conflict-of-law rules.

Any such dispute must be brought only in the state or federal courts located in the state in which MK&SJ, LLC is organized, and you and we consent to the personal jurisdiction of those courts. Nothing in this section takes away any protection that the mandatory law of the place where you live gives you, including any right to bring a claim in your local courts.

13. Changes

We may update these terms from time to time. When we do, we will change the effective date at the top of this page. Changes apply from that date, and if you keep using the site afterward, you accept the updated terms. We may also change, suspend or stop any part of the site or the newsletter at any time.

14. Other terms

These terms are the entire agreement between you and us about your use of the site. If any part of them is found unenforceable, the rest stays in effect. If we don’t enforce a term right away, we haven’t given up our right to enforce it later. You may not transfer your rights under these terms, but we may transfer ours.
